These Terms and Conditions ("Terms") govern your use of the Evercinder mobile application ("App") distributed via the Apple App Store. By accessing or using the App, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not use the App.
You acknowledge that you are at least 18 years of age and have the legal capacity to enter into these Terms. If you are using the App on behalf of a company or organization, you represent that you have the authority to bind that entity to these Terms.
The App may contain links to third-party websites that are not owned or controlled by Evercinder. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites. You acknowledge and agree that Evercinder shall not be liable for any damages or losses caused or alleged to be caused by or in connection with your use of any such content, goods, or services available on or through any such websites.
The App may include links to third-party social media platforms. Your use of these links is at your own risk, and you should review the terms and conditions and privacy policies of any third-party social media platforms you visit.
We may terminate or suspend your access to the App immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms. Upon termination, your right to use the App will cease immediately.
In no event shall Evercinder, its directors, employees, partners, agents, suppliers, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:
The App is provided on an "AS IS" and "AS AVAILABLE" basis. Evercinder makes no representations or warranties of any kind, express or implied, regarding the operation of the App or the information, content, materials, or products included in the App. You expressly agree that your use of the App is at your sole risk.
These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law principles.
Any dispute arising out of or relating to these Terms or your use of the App shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall take place in the United States, and the language of the arbitration shall be English.

You represent and warrant that your use of the App will comply with all applicable laws and regulations in the United States.
If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions of these Terms shall remain in full force and effect. Our failure to enforce any right or provision of these Terms shall not be deemed a waiver of such right or provision.
These Terms may be translated into other languages. In the event of a conflict between the English version and any translated version, the English version shall prevail.
We reserve the right to modify or replace these Terms at any time. If we make material changes, we will provide notice through the App or by other means. Your continued use of the App after any such changes constitutes your acceptance of the new Terms.
